DUI Arrest

Arresting a person for a DUI means that someone who is driving under the influence of alcohol or drugs has been apprehended by law enforcement. DUI arrests are normally made when a person’s blood alcohol level is 0.08 or greater. An underage person drinking alcohol or taking drugs, and is in a state that has a zero tolerance law will be arrested for DUI even if he or she does not have a blood alcohol concentration of 0.08. These states do not tolerate minors on the road under the influence. There are also some states in the United States that will bump up the DUI punishment if a person’s blood alcohol level is quite high, in the 0.15 to 0.20 level. DUI arrests can take place during a motor vehicle accident, or when a roadblock has been set up. If a car is being driven erratically, the car will be pulled over by law enforcement, and the driver questioned. If warranted, field sobriety tests will be performed. A breathalyzer test may also take place, but this may take place at the police station. Once there is enough legal evidence that the driver is under the influence of alcohol or drugs, he or she will be arrested.
