Domestic Violence Sentencing

During domestic violence sentencing it is important for the victim to be able to express his or her wishes to the court. In many areas a Domestic Violence Shelter or program will provide an advocate to go with the victim to the court to be able to make a statement to the judge at the time of sentencing. In addition during this time the judge will also take into consideration the recommendations of the prosecuting attorney as well as any mitigating factors. Mitigating factors are not designed to excuse the crime, rather they are circumstances which may provide for mercy or compassion during sentencing. In a domestic violence charge this may include if this is a first time offense, if the offender has sought out counseling or other anger management programs voluntarily, if the individuals are in some type of marriage or family therapy or if there are other factors to consider. Typically if it is a second or further occurrence of domestic violence sentencing will be much less permissive or considering of these factors.
