Disorderly Conduct Charge

A disorderly conduct charge is typically going to be at the misdemeanor level and can occur for basically any behavior that disrupts the peace or causes a disturbance of annoyance. Often this charge is used in combination with other charges such as public intoxication or even trespass, vandalism or other misdemeanors. In situations where individuals have a disorderly conduct charge it is entirely likely that, if it is a first time offense, the judge will accept a plea and restitution, fines or community service. For some disorderly conduct there is the option for the prosecutor to proceed with a felony charge. In some states cases such as false information in a police report or at the time of an arrest, or failing to calm down after being warned by an officer to cease the disturbing behavior may result in a felony, but these are very specific cases. Often disorderly conduct charges result in the misdemeanor being dropped to a violation, which is typically handled more like a traffic ticket, at least in the first instance.
