Child Abuse Penalties

Child abuse is the intentional mistreatment of a child under 16 years of age through physical, mental, psychological, and emotional abuse or neglect. Child abuse can be classified as a felony or misdemeanor, depending on the degree of injury to the child, and the penalties vary by state. However, for felony child abuse, the penalty often begins with removing the child from the home where the abuse occurred and therapy for the perpetrator. This may be followed by fines up to $20,000 and/or jail time of up to twenty-five years. Failure to report known child abuse is also a crime. It is considered a misdemeanor in 38 states and a felony in others. The sentence for this crime can be jail time of up to 5 years and/or fines up to $5,000. The guilty party can also be sued in civil court for any resulting damages.
