California Vandalism

Vandalism occurs when one defaces, damages, or destroys the personal property of another. Vandalism can include damage by spray painting, writing with felt tip markers, knives, or any instrument by which marks or impressions can be left. Some common forms of vandalism include graffiti, culture jamming, sniggling, or billboard “liberation.” If the vandalism is directed toward a certain class of people, such as race or religion, it may be classified as a hate crime. Penalties for vandalism vary by municipality; however, vandalism can be classified as a misdemeanor or felony, depending primarily on the monetary value of the damage.

Fast Facts

  • Vandalism can be charged when one merely carries the tools to vandalize with the apparent intent to cause such damage
  • In most cases perpetrators are required to repair the damage they have caused or, if the minor cannot do so, parents or guardians may be required to do so
  • Fines for vandalism can range between $1,000 and $5,000. Some people consider graffiti to be an art form and condemn its punishment
