Assault With A Deadly Weapon

Assault with a deadly weapon is a crime that most of us have heard of. It takes place when a person threatens another with a weapon that can cause death. Most people think of a gun or knife when assault with a deadly weapon is discussed, but the weapon in question can be many different things. A deadly weapon can also be an automobile, a fork, a vicious dog, or the heel of a high-heeled shoe. A rubber band shot into someone’s eye would definitely be considered as a deadly weapon. So would a vase used to hit someone in the head. It all depends on what the courts decide, but generally, most anything that could injure someone is considered a deadly weapon. In these two last examples, the charges brought against the perpetrator would be battery instead of assault with a deadly weapon, as the weapon actually touched the victim. Simply threatening the victim would warrant the assault charge.
