An aggravated assault definition is fairly standard in all states and typically includes the intent or the willful act of causing bodily harm to another individual in a way that shows indifference to human life. This may include significant threats to kill, maim or rape the victim, whether or not any actual contact between the victim and offender occurred. Aggravate assault is more significant in intent and nature than simple assault and often but not always includes the use of a deadly weapon. A deadly weapon may include a firearm, knife, or other instrument such as a bat or an axe. In almost all situations having a weapon during an assault will increase it to an aggravate assault, with a firearm being considered the most significant deadly weapon. Aggravated assault, when the assault occurs, is often much more significant and the chance of bodily injury to the victim is much greater than what would be considered in a simple assault charge.
